1. INTRODUCTION
Welcome to Yprac! We provide software and services to help users measure their performance in competitive video games for fun. We do so via the Yprac website (the “Site”), the Yprac application (the “App”) and related Internet services (collectively, the “Service(s)”). The Service is operated by Yprac AB. (the “Company”, “we” or “us”) for users of the Service (“you”). This Privacy Policy (“Policy”) sets forth our policy with respect to information that is collected from visitors to the Site and users of the Services. For the purposes of the Data protection Act 1998, under applicable law, Yprac AB is the “data controller” of personal data collected through the Services.
If you do not agree with this Privacy Policy, please do not participate in the Services offered through the Site and the App.
2. YOUR RIGHTS AND YOUR PREFERENCES
You have certain rights in relation to the Personal Data that we hold about you, as detailed below. We reserve the right to ask for reasonable evidence to verify your identity before we provide you with any information and/or comply with any of your requests, as detailed below:
Right of access and data portabilityYou have a right to know what Personal Data we collect about you and, in some cases, to have the information communicated to you. Subject to the limitations in applicable law, you may be entitled to obtain from us a copy of the Personal Data you provided to us in a structured, commonly-used, and machine-readable format. If you wish to exercise this right please contact us letting us know what information in particular you would like to receive. Subject to applicable law, we may charge you with a fee. Please note that we may not be able to provide you with all the information you request, for instance, if the information includes Personal Data about another person.
Right to correct personal dataYou may request that we update, correct or delete inaccurate or outdated Personal Data and/or that we suspend the use of Personal Data, the accuracy of which you may contest, while we verify the status of that Personal Data. If you want to edit your data, please notify us by contacting us as detailed in this Policy. We will process your request as soon as possible, however it may take a few days for us to update our records before any correction is effective.
Deletion of personal data ("Right to be forgotten")You have a right to have Personal Data that we hold about you deleted. Should you wish to have any Personal Data about you deleted, please notify us by contacting us as detailed in this Policy. We will process your request as soon as possible, however it may take a few days for us to update our records before any deletion is effective. We cannot restore information once it has been deleted. We may retain certain Personal Data (including following your request to delete) for audit and record-keeping purposes, as well as other purposes, all as permissible and/or required under applicable law. We may also retain your information in an anonymized form.
Account deactivationYou have the right to deactivate and effectively delete your Yprac account. This can be done from the Account Management page on the Yprac site. This action is permanent and can not be undone. Deleting your Yprac account will also delete your personal data, as described in the previous section.
Right to restrict processingYou may request at any time that we limit the processing of your Personal Data. If you want to, please notify us by contacting us as detailed in this Policy. We will process your request as soon as possible, however it may take a few days for us to update our records before any restriction is effective.
Direct marketing opt outYou have to right to opt out of any direct marketing communications from us and/or having your Personal Data processed for direct marketing purposes. If you want to, please notify us by contacting us as detailed in this Policy. We will process your request as soon as possible, however it may take a few days for us to update our records before any opt out is effective.
Right to objectYou have the right to object to processing of your Personal Data including for the purpose of direct marketing. If you want to object to processing, please notify us by contacting us as detailed in the end of this Policy.
Withdrawal of consentYou may withdraw your consent in connection with any processing of your Personal Data based on a previously granted consent. If you want to withdraw consent, please notify us by contacting us as detailed in the end of this Policy.
Supervisory authorityIf you are a European Citizen, you may have the right to submit a complaint to the relevant supervisory data protection authority. If you have any complaint about this Policy please reach out by contacting us as detailed in the end of this Policy.
3. HOW DO WE COLLECT PERSONAL DATA?
We collect personal data in the following ways:
When you sign up to the Yprac ServiceWhen you register a new free account on the Site we collect certain personal data in order for you to use the Yprac Service. Such data include your display name, email address, and birth date.
Through your use of the Yprac ServiceWhen you use the Yprac Service we collect data about your gameplay in order to measure your performance. This data is collected through technologies provided by the game developer, such as gamestate integration, demo parsing and console logging. Data from within the Yprac Service is also collected, such as what activities you have completed and what workouts you have created.
When you sign up for a payed subscriptionWhen you choose to support Yprac by purchasing a subscription, you will need to submit additional payment data to perform the purchase. We have partnered with Stripe to conveniently and securely process payments. Data collected through stripe include your name, billing details, and credit card information.
4. WHAT PERSONAL DATA DO WE COLLECT?
We collect the following types of data:
Account Registration DataThis is the personal data you provide that enables us to create your Yprac Account, it may include:
- Your display name;
- Email address;
- Date of birth;
This is data that is collected through your use of the Yprac Service, it may include:
- Information about your Yprac Subscription plan;
- Information about your use of the Yprac Service, including the date and time when you log in, your activities you rename or favorite and workouts you create;
- Information about your gameplay, including the date and time you start and complete an activity, statistics regarding your performance and recorded demos of you playing the game;
This is data you provide in order to purchase one of our paid subscription plans, it may include:
- Name;
- Billing Information;
- Credit or debit card type, expiration date, and certain digits of your card number;
5. WHAT DO WE USE YOU PERSONAL DATA FOR?
When you use or interact with the Yprac Service, we use a variety of technologies to process the personal data we collect about you for various reasons. In this section we have set out the reasons why we process your personal data (‘processing purpose’), the associated legal bases we rely upon to legally permit us to process your personal data, and the categories of personal data (identified in Section 4 ‘What personal data do we collect from you?’) used for these purposes.
The following purposes use ‘Account Registration Data’ and ‘Service Usage Data’ on the legal basis of ‘Performance of a Contract’ and ‘Legitimate Interest’:
- To open and maintain your Yprac account;
- To provide the Service requested by you;
- To ensure technical functionality of the Yprac Services and to understand and analyze your usage of the Service in order to improve the Service;
- To provide personalized and relevant statistics about your game playing performance;
- To contact you regarding updates to the Service, your account status and upcoming events;
- To notify you of changes to the Terms & Conditions and any other policies or agreements relevant to the Site, including this Policy;
- To ensure that you comply with the Terms & Conditions and are permitted to create an account based upon your age and where you reside;
We also use ‘Payment Data’ in order to process payments and to detect fraudulent use of the Yprac Service. We do this on the legal basis of ‘Performance of a Contract’, ‘Compliance of legal obligations’ and ‘Legitimate Interest’.
6. SHARING YOUR DATA
We disclose your information for certain purposes and to third parties, as described below:
Publicly Available DataThis data will always be publically available on the Yprac Service. It includes:
- Your name and/or username;
- Your profile picture;
- Your skill rating;
- Your level ranking;
- Your Yprac friends;
- When you joined Yprac;
and, provided it doesn’t identify you personally, shall not be considered Personal Information.
Service ProvidersWe use other companies, agents or contractors ("Service Providers") to perform services on our behalf or to assist us with the provision of services to you. For example, we engage Service Providers to process credit card transactions or other payment methods, to analyze and enhance data, and to process and administer consumer surveys. In the course of providing such services, these Service Providers may have access to your personal or other information. We do not authorize them to use or disclose your personal information except in connection with providing their services.
Legal ObligationsWe may disclose your information if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, (ii) protect and defend the rights or property of the Company, (iii) protect the personal safety of users of the Services or the public, or (iv) protect against legal liability.
Aggregate Information and Non-Identifying InformationWe use anonymised and aggregated data for purposes including research, data analysis, marketing, improving existing features and developing new features within the Yprac Service. We may share aggregated information that does not include personal data and we may otherwise disclose non-identifying information to third parties for industry analysis, demographic profiling and other purposes. Any aggregated information shared in these contexts will not contain your personal data.
Business transfersIn connection with any reorganization, restructuring, merger or sale, or other transfer of assets, we will transfer information, including personal information, provided that the receiving party agrees to respect your personal information in a manner that is consistent with this Privacy Statement.

7. TRANSFER TO OTHER COUNTRIES
We share the Personal Data we collect with our international service providers and subcontractors who assist us in the operation of the Services and process the information on our behalf and under our instructions. We will ensure that we have agreements in place with such parties that ensure the same level of privacy and data protection as set forth in this Privacy Notice. You hereby consent to such international transfer.
8. KEEPING YOUR PERSONAL DATA SAFE
We implement industry standard measures aimed at reducing the risks of damage and unauthorized access or use of Personal Data, but they do not provide absolute information security. Such measures include physical, electronic, and procedural safeguards (such as secure servers, firewalls, antivirus and SSL encryption), access control, and other internal security policies.
9. DATA RETENTION AND DELETION
We generally retain personal data for so long as it may be relevant to the purposes identified herein. To dispose of personal data, we may anonymize it, delete it or take other appropriate steps. Data may persist in copies made for backup and business continuity purposes for additional time.
10. LINKS TO THIRD PARTIES
Sometimes we display advertisements from third parties and other content that links to third-party websites. We cannot control or be held responsible for third parties’ privacy practices and content. If you click on a third-party advertisement or link this privacy policy will not apply. You have left the Yprac service and any personal data you provide will instead be covered by their policy.
11. CHILDREN
If you are an individual under the age of eighteen (18) you need the consent of your parents/tutors to register. If you become aware of an individual under the age of eighteen (18) has enrolled without parental permission, please contact us at support@yprac.com.
The Yprac Services are not directed to individuals under the age of thirteen (13). Yprac does not knowingly collect personal information from such individuals and we request that they not provide personal information through the Services. In some countries, stricter age limits may apply under local law. If we learn that we have collected or received personal information from a child, we will take reasonable steps to delete the personal data, as well as the Yprac account for the child. 12. GOVERNING
The Service, Privacy Policy and the Terms & Conditions shall be governed by and construed in accordance with Swedish law. Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the Swedish courts. By using the service, you agree that any dispute that cannot be resolved between the parties shall be resolved individually, without resort to any form of class action. You further agree that any legal action arising from any dispute shall proceed only in the Swedish courts, or as otherwise determined by us, and you hereby submit to personal jurisdiction and venue in such courts for the purposes of litigating any such action. We make no representation that this Service is operated in accordance with the laws or regulations of, or governed by, other nations.
13. CHANGES TO THIS PRIVACY POLICY
We will occasionally update this Policy in response to changing legal requirements or when we have developed new additional services. We will notify you of any material updates together with the date when the changes will take effect. Please make sure you read any such notice carefully. Your continued use of the Yprac Services after any such updates take effect will constitute acknowledgement and acceptance of those changes. If you do not wish to acknowledge or accept any updates to this Privacy Statement, you may cancel your use of the Yprac Services.
